My tenant has 3 months’ rent arrears. What notice do I serve?

For rent arrears you serve a Section 8 Notice relying on Ground 8 (mandatory — at least 2 months’ arrears both at notice and at hearing) and/or Grounds 10 and 11. Following the Renters’ Rights Act 2025, Section 21 no-fault notices are abolished.

The notice period for Ground 8 is 2 weeks. If arrears remain at or above 2 months at the possession hearing, the court must grant the order.

Landlord hasn’t protected my deposit. What are my remedies?

If the landlord failed to protect the deposit within 30 days of receipt or failed to provide the prescribed information, you can apply to the county court for compensation of 1–3 times the deposit amount (Housing Act 2004, s.214).

The landlord also cannot validly serve a possession notice while the deposit remains unprotected.
